We may Process different kinds of Personal Data about you which we have grouped together as follows:

We do not collect following data from you:
 

  • race, creed, social status, medical history, criminal record, record as a criminal victim
  • physical handicap, intellectual handicap, mental disorder
  • results of medical examination and other examination
  • health guidance, medical treatment / dispensing information
  • proceedings concerning criminal cases such as arrest and search, having the data subject as the suspect or the accused
  • proceedings concerning protection cases of juveniles such as protective dispositions, having the data subject as a juvenile delinquent person or a person suspected to be a juvenile delinquent

  • To our service providers with the appropriate management and supervision including those providing us with cloud computing, customer relation management, marketing automation, advertising, messaging or other application, business travel arrangement, courier, receptionist, conference/event arrangement, hospitality, accommodation.
  • To a party that merge or acquire part or all of our business or assets.

International Transfers

As part of our global business operations, NAGASE may transfer your personal data to third parties located outside of Philippines. In accordance with the DPA, we ensure that such transfers are conducted lawfully and securely.

Information to Be Disclosed or Notified
 

  • Items of personal data to be transferred : Full name, company name, email address.
  • The country to which the personal data will be transferred, and the timing and method of the transfer : The personal data will be transferred to Japan. The transfer will be conducted electronically at the time of service provision.
  • The name and contact information of the recipient (in case of a corporation, its name and contact details) : The recipient of the personal data is Nagase & Co., Ltd. [Tokiwabashi Tower, 2-6-4 Otemachi, Chiyoda-ku, Tokyo 100-8142, Japan]
  • The purpose of use and the retention/use period of the personal data by the recipient : The personal data will be used by Nagase & Co., Ltd. for service coordination and communication, and retained for the duration necessary to fulfill the stated purpose, in accordance with applicable laws and regulations.
  • The method, procedure, and effect of refusing the transfer of personal data : Customers will fill in the form in our Website after agreeing to the Privacy Policy (which includes consenting to transfer of information to third parties as disclosed therein) when they want to make inquiries. Inquiries will be received by MPO (Nagase Co., Ltd.) and then forwarded to Nagase Philippines. The data of inquiries will be stored at Salesforce, which server is located in the United States of America (U.S.A.).
     

NAGASE will implement appropriate safeguards for international transfers, such as contractual protections (e.g., standard contractual clauses in accordance with the Republic Act No. 10173), participation in privacy certification programs (e.g., CBPR), and other legally recognized mechanisms to ensure that your personal data is adequately protected.

How Long We Keep Your Personal Data

We will retain your Personal Data we collected for the period necessary to fulfill the purposes stated in this Privacy Policy, unless a longer retention period is required by law. After such retention period, your Personal Data will be deleted promptly and safely.

Legal Rights with Regard to Your Personal Data

We respect your privacy rights and provide you with reasonable access to your Personal Data that you have provided. Based on the applicable law to your Personal Data, and within the limits of the applicable law, you may have the right to access, obtain, rectification, move, copy, or transfer Personal Data securely, erasure, blocking, restrict Processing, object to Processing, suspension of data transfer, withdraw consent, claim compensation if you believe you suffered damages due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of personal data or for violating your rights and freedoms as a data subject, and file a complaint with the NPC if your personal information has been misused, maliciously disclosed, or improperly disposed of or that your data privacy rights have been violated. We follow generally accepted industry standards to protect the information submitted to us, both during transmission at our Website and once we receive it. We maintain appropriate administrative, technical, and physical safeguards to protect your Personal Data collected by us against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse, and any other unlawful form of Processing of your Personal Data in our possession.

Personal Data of Business Partners Located in the European Economic Area (EEA)

Within the limits of applicable law, our Business Partners located in the European Economic Area (“EEA”) have the right to access, rectification, erasure, restrict Processing, object to Processing, data portability, and not be subject to a decision making based solely on automated Processing, including profiling, with legal or similarly significant effects. In addition, our Business Partners located in the EEA may withdraw their consent to the processing of their personal data at any time. Our Business Partners located in the EEA also have the right to lodge a complaint with the competent data protection authority concerning the processing of their personal data.
